One need not know much history of semiotics in order to recognize the background of my title. It is of course an allusion to Umberto Eco’s classic Struttura assente from 1968, which turned out to be a major touchstone in the history of European semiotics. At that time, everything about semiotics had become “structural”. But why, for Eco, was structure “absent”? This notion of absence reveals something essential in both the history of structuralism and in the reasoning to which most (...) semiotics has remained faithful – namely, that “true” reality is not that which can be seen, heard or felt, but the structure behind and causing any manifest phenomenon. As Greimas put it, any surface reality was only an “effet du sens”, a meaning-effect. In a word, manifest reality is only Schein – appearance, illusion – a notion that may be found as early as in the teachings of Schiller and Kant. Getting at the structure involves the kind of reductionism described by Mireille Marc-Lipiansky: réductionnisme qui cherche à ramener le supérieur à l’inférieur. Under the category of “antihumanism”, she distinguished among four different phases of reductionism: the reduction of the individual to the collective; the reduction of the conscious to unconscious categories; the reduction of consciousness to an unconscious regulative agglomeration or “combinatory”, which eliminates the creative activity of a subject and of history; and finally, the reduction of freedom to necessity. One cannot think of a better summary of the issue, and to judge from the world around us, this world-view has certainly won out. (shrink)

The question of whether biologists should continue to use the Linnaean hierarchy has been a hotly debated issue. Invented before the introduction of evolutionary theory, Linnaeus's system of classifying organisms is based on outdated theoretical assumptions, and is thought to be unable to provide accurate biological classifications. Marc Ereshefsky argues that biologists should abandon the Linnaean system and adopt an alternative that is more in line with evolutionary theory. He traces the evolution of the Linnaean hierarchy from its introduction (...) to the present. He illustrates how the continued use of this system hampers our ability to classify the organic world, and then goes on to make specific recommendations for a post-Linnaean method of classification. Accessible to a wide range of readers by providing introductory chapters to the philosophy of classification and the taxonomy of biology, the book will interest both scholars and students of biology and the philosophy of science. At the moment of its decline, we clearly see that painting in oils developed an original poetics, and one that was all of a piece, throughout a renascent and modern West. From its birth and during a development lasting half a millennium we see it— in Florence, Bruges, Venice, Rome, Toledo, Nuremberg, Amsterdam and Paris—attentive to the sources of signification: languages, rites, myths, theater, tools, techniques and sciences and the urban context that wove them all together. In each case, for (...) one or the other of them, it brought a new relationship to the way of life and then left them to their social order of assimilation, keeping the initial contact for those who would be interested. It studded the West with centers of production that carried the practice and knowledge of art to their limits; engaged with the collective imagination, it punctuated history with decisive works, in which the desire to paint takes action and explains it. Marked by an impatience for change, oil painting revealed itself in a rapport with creativity akin to the other works of civilization. It is at the level of the bases of invention of the imaginary—which are in any expression the most profound structures—that the unfolding of oil painting is tightly bound. The establishment of modern national languages, the orderly rise, around a syntax and because of architecture, sculpture, music, song, tragedy, the systematic construction of scientific and technical expression, arose and grew quickly in importance in Western Europe during the same centuries as painting and with reciprocal correspondence. Dürer “who was the first to publish a treatise in which is collected all knowledge having to do with the expression of forms… wrote in his native tongue and in so doing was revealed as the creator of technical and scientific German.”. There are, it is said nowadays, “Renaissances,” in order to emphasize the diversity of expressions in this period of civilization and because of the concern for restoring the originality of the historical situations experienced at that time by the peoples of Europe. It is true that from the fourteenth to the fifteenth centuries, the Renaissance touched many areas in order to provide a response to challenges of the times. This paper explores the nature of the relationship between corporate social responsibility (CSR) and competitiveness. We start with the commonly held view that firm competitiveness is defined by the market. That is, the question of what are the critical competitiveness factors is answered by looking at how companies and financial analysts describe and evaluate a firm. To analyze this, we review the current state of the art on the relationship between CSR and competitiveness. Second, CSR criteria used by financial analysts (...) is identified and compared with company valuation methods. Third, the results of a multi-stakeholder dialogue on CSR and competitiveness of the European financial sector are presented. As a conclusion, we argue that CSR and competitiveness relate through a learning and innovation cycle, where corporate values, policies and practices are permanently defined and re-defined. Thus, we propose that learning takes place as CSR is embedded in business processes, and that once it has been integrated, in turn, it generates innovative practices, and finally, competitiveness. At the end of the paper, we propose that CSR in practice consists of managing inherent paradoxes generated by the tension between CSR and business policies. (shrink)

This text discusses the impact of immersive technologies on our identity and relationship to digital and analogue modalities in a non-normative way. It references the work of Joseph Beuys, specifically his iconic performance of being confined with a coyote in a gallery space for three days, to construct connections between borders, edges, limits and identity, face presentation, representation and projection towards ourselves and our audiences. We reference the works of Marcel Duchamp and George Orwell and compare the immersive devices of (...) the nineteenth century to current technology. Various works of art and literature are used to illustrate the impact of technology on society and the individual’s relationship to the collective imagination. The text raises questions about the limits or nonlimits of exposure of identity through machinic and technological devices or processes in the context of privacy of expression in a contemporary networked world. Serious concerns about pervasive, persistent, and unjustified social inequalities have prompted a small—but growing—number of academic commentators to raise some hard and troubling questions for those who would like to legalize physician-assisted suicide. In various ways, these commentators have asked: In light of existing social inequalities—inequalities that operate, for example, along sometimes intersecting lines of race, class, age, sex, and disability—how persuasive are autonomy-based arguments in favor of legalization of assisted suicide when those arguments depend on a conception of autonomy (...) that either presupposes social equality or does not expressly account for its absence? How compelling are arguments that we ought to legalize assisted suicide out of feelings of mercy for the sick and dying, when such affective expressions may actually be the socially acceptable manifestation of private ambivalence that includes merciless discrimination? If a potential person would have a good life if he were to come into existence, can we regard his coming into existence as better for him than his never coming into existence? And can we regard the situation in which he never comes into existence as worse for him? In this paper, we argue that both questions should be answered affirmatively.

This paper explores the biographical and cultural sources that inspired the decision of Janusz Korczak to make his life’s vocation the education of young children from dysfunctional families. This decision emerged out of the radical version of humanism he embraced. His identification of children as the population his humanist ethos must serve, distinguishes it from other versions of humanism. The paper explores the role his sense of self and his identification with Poles, Jews, and humanity play in the composition of (...) this humanism. It identifies the hybridity of his cultural identifications as its heart. It proposes that the tensions between these identifications in general, and his non-Jewish Jewish identification that situated him as being ‘a part of’ and ‘apart from’ Polish society in particular, induced Korczak to create a universal religion of children in which religious, ethnic, or physical distinctions do not generate prejudice, intolerance, and violence. This article seeks to explain how it was possible that, until the first century BC, the Roman dictatorship was never abused and turned against the constitution itself. The traditional explanation is that, contrary to its first century imitations, the dictatorship was subject to formal restrictions, such as the six months' tenure, which were strictly applied. By contrast, this article suggests that informal constraints on the dictator's powers, such as moral and religious norms, were as important as formal constraints. In recent decades a number of criminal convictions have been reversed on appeal, partially on the basis of problems associated with the use of scientific evidence adduced by the prosecution during the trial. These miscarriage of justice cases have received considerable attention from news media, legal commentators, criminologists and in formal public inquiries. Most responses to these cases have been critical of the scientific evidence originally relied upon at trial. Few commentators have been critical of, or even reflective about, the (...) scientific evidence used to acquit. Generally, their analyses have utilized idealized images of science and scientists. In contrast, by importing the concept of methodological symmetry from science studies, this paper aims to identify and explore the conceptual disparity (or asymmetry) between the assessment of scientific evidence used to convict and the scientific evidence used to acquit. In order to illustrate some of the limits to conventional approaches to miscarriages of justice as well as examine the judicial use of scientific evidence this will be undertaken in relation to the successful appeal of the Birmingham Six. This article reviews contemporary response to several contrasting strands of recent empirical work. It begins with discussing the scope and rationale of evidence law. Experimental studies on eyewitness memory and testimony illustrate the potential value of empirical studies to the practice of investigations, prosecutions, and appeals. This article discusses several lines of empirical inquiry employing diverse methodologies, experiments, surveys, and approaches and reviews their limitations, and implications and significance for the understanding and practice of law. Many of the contributions from (...) empirical legal studies are provisional and their precise value for practice is uncertain or ambiguous, but they raise important issues worthy of serious consideration. By identifying problems with eyewitness evidence and the limitations of many of the forensic sciences, and in many other ways, empirical and experimental studies have substantially outpaced legal experience. Indifference to empirical legal study is likely to reduce the social legitimacy of legal institutions. (shrink)

Over the last two decades judges (and regulators) in all common law jurisdictions have increased their reliance on published medical and scientific literature. During the same period biomedical research has undergone fundamental and unprecedented change. This article explores some of the changes to the location, organization and funding of biomedical research in order to assess their implications for liability and proof. Focusing on peer review and publication, along with reforms promoted by the editors of some of the world's pre-eminent general (...) medical journals (e.g. British Medical Journal, the Lancet, Journal of the American Medical Association and the New England Journal of Medicine), this article considers how judges might respond to recent findings which suggest that corporate sponsorship systematically biases biomedical research. Given that common law judges have been reforming rules of evidence and procedure in search of impartial expertise and privileging published biomedical research, how should they respond to the strategic manipulation of the scientific record? Unknown peers create a problem for those epistemologists who argue that we should be conciliatory in cases of peer disagreement. The standard interpretation of ‘being conciliatory’ has it that we should revise our opinions concerning a specific subject matter whenever we encounter someone who is as competent and well informed as we are concerning this subject matter (and thus is our peer) and holds a different opinion. As a consequence, peers whom we have never encountered and who are hence unknown (...) to us are not taken into account. This, however, appears odd; not only because it is an accidental matter which peers we happen to encounter and which not, but also because it would allow people to deliberately isolate themselves from any kind of intellectual exchange on the topic under consideration. The paper argues that we should take the problem of unknown peers seriously, and that disregarding the problem is an instance of the more general mistake of assuming that evidential quality and justified believability can be dealt with separately. Moreover, a solution to the problem of unknown peers is suggested. (shrink)

The singular expertise of family physicians is the ability to manage complexity with pragmatism, both clinically and ethically. Telemedicine raises multiple questions about the nature of the patient‐physician relationship as manifested in clinical encounters. Some of these questions are concerning, underscoring the need to assess whether medical care is better with this new technology—or if it is just different or maybe even worse. It seems clear, however, that, regardless of its limitations, telemedicine is here to stay. Describe a successful classroom teaching tactic that could be replicated by other instructors. -/- The context: This activity was used in a required undergraduate introductory theology course at a Catholic college. I tried this exercise a month into class, at the start of a section on creation in Genesis. -/- The pedagogical purpose: The activity encourages students to deepen the skill of reading and understanding the Bible. It also invites students to use their imagination in recognizing the goodness and variety (...) of creation described in Genesis 1. It takes place mostly outdoors, in a natural setting that mirrors the richness of the text, and encourages students to observe their surroundings in light of the text. Doing this as a group creates a positive learning environ- ment; for example, the more active students act as role models of paying attention to detail, observing closely, and taking photos. The exercise mirrors the typical proclamation of Scripture within a communal context. (shrink)

One underappreciated aspect of the practice of nonviolence and just peace is the imperative for the Church to welcome those on the margins, including children and adults with physical and/or intellectual impairments who are vulnerable to dehumanization. Too many children and adults with impairments and their families have not been fully welcomed as sisters and brothers in their local parish. Catholics can draw on a rich theology of peacebuilding in Scripture, Tradition, and Church teaching to respond to these vulnerabilities. One of the demands facing the church is the call for unity with Christians with profound intellectual and physical impairments. As the church becomes a community of justice with and for people with impairments, she is an instrument of God's shalom. However, too many of our sisters and brothers with impairments find themselves on the outside looking in. How can the church continue to move toward a more complete welcome and participation? Responding to this theological question precedes clinical or legal (...) concerns. The best the world has to offer is not what the church needs, though she can learn from reasonable professional approaches. The message and peace of Christ can undo the walls of separation that keep Christians with impairments out. Such a transformation would be a sign that the church is being built up in peace, and would offer a model of true communion among a diversity of people. (shrink)

Dans le cadre du développement récent de la stylistique outillée, cet article propose une réflexion sur l’application de ce concept et de ses méthodes aux personnages de théâtre sur la base d’un corpus trilingue de tragédies : Euripide, Sénèque et Corneille. Pour mener la recherche, nous aborderons d’abord la question de la nature des rôles de théâtre entre unités textuelles recomposées et discours de personnages dans le cadre d’une performance sur scène. Ensuite, nous chercherons à définir si les caractéristiques de (...) ces unités peuvent être rapprochées de la notion de style. Nous en étudierons les apports pour la compréhension d’une œuvre de théâtre. Pour atteindre cet objectif, une attention particulière sera accordée au corpus de recherche (quelles œuvres choisir?), à sa constitution (comment diviser ce corpus et avec quel niveau de granularité?) et aux outils d’exploration (qualitative ou quantitative?). En stylistique outillée, le corpus devient lui-même un outil de recherche en tant qu’opérateur de contraste. Enfin, poursuivre cette enquête amène à questionner la frontière entre études du discours et stylistique outillée du point de vue de leurs objectifs et de leurs méthodes. (shrink)
